General Terms & Conditions

1. Acceptance of Terms

By accessing or using the Simple Auto platform at simpleauto.app ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service. These terms apply to all users, including auto shop operators ("Partners") and their customers ("Renters").

2. Description of Service

Simple Auto is a rental management platform that enables auto repair shops to manage loaner vehicle rentals for customers whose vehicles are being serviced. The Service includes rental agreement generation, digital signature collection, vehicle documentation, payment processing, and communication tools.

Simple Auto is a technology platform that facilitates rental management. The actual rental transaction is between the auto shop (Partner) and the customer (Renter). Simple Auto is not a party to the rental agreement.

3. Account Registration

  • Partners must provide accurate business information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • One account per individual. Account sharing is not permitted.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Rental Agreements

Rental agreements generated through the Service are legally binding contracts between the Partner and the Renter. By digitally signing a rental agreement through our platform:

  • You acknowledge that your electronic signature carries the same legal weight as a handwritten signature.
  • You confirm that the information provided (driver's license, contact details) is accurate and current.
  • You agree to the terms specified in the rental agreement, including vehicle return conditions, mileage limits, and liability provisions.

Simple Auto stores signed agreements and associated documentation (vehicle photos, mileage records) as a record-keeping service. We do not modify or interpret rental agreement terms.

5. Payments

Payment processing is handled securely by Stripe. By providing payment information through our platform:

  • You authorize the Partner to place a hold on your payment method as a security deposit.
  • You understand that holds may be captured (charged) or released based on the rental outcome.
  • Payment disputes should be directed to the Partner (auto shop) in the first instance.
  • Simple Auto does not store your credit card numbers. All payment data is handled by Stripe in compliance with PCI DSS standards.

6. SMS Communications

By providing your phone number during the rental process, you consent to receive transactional SMS messages related to your rental, including:

  • Signature request links for rental agreements
  • Rental status notifications
  • Payment reminders

These are transactional messages only — we do not send marketing or promotional texts. You may opt out at any time by replying STOP. Message and data rates may apply. Message frequency varies based on rental activity (typically 1–5 messages per rental). See our SMS Messaging Terms for full details.

7. Partner Responsibilities

Partners (auto shop operators) using the Service agree to:

  • Maintain valid business licenses and insurance for rental vehicles.
  • Ensure all rental vehicles meet safety and roadworthiness standards.
  • Accurately represent vehicle condition and rental terms to customers.
  • Comply with all applicable local, state, and federal laws regarding vehicle rentals.
  • Protect customer personal information accessed through the platform.
  • Not use the platform for any unlawful purpose.

8. Renter Responsibilities

Renters using loaner vehicles agree to:

  • Possess a valid driver's license for the duration of the rental.
  • Operate the vehicle in accordance with all traffic laws and regulations.
  • Return the vehicle in the same condition as received, subject to normal wear.
  • Report any accidents, damage, or mechanical issues immediately to the Partner.
  • Not sublease or allow unauthorized drivers to operate the rental vehicle.

9. Intellectual Property

The Simple Auto platform, including its design, code, logos, and content, is the property of Simple Auto and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without prior written consent.

10. Limitation of Liability

Simple Auto provides a technology platform for rental management. To the maximum extent permitted by law:

  • We are not liable for any disputes between Partners and Renters.
  • We are not liable for vehicle condition, accidents, or damage during rentals.
  • We are not responsible for the accuracy of information provided by users.
  • Our total liability for any claim shall not exceed the fees paid to Simple Auto in the 12 months preceding the claim.
  • We are not liable for indirect, incidental, or consequential damages.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any loss resulting from service interruptions.

12. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability and intellectual property) will remain in effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify active users.
